These Terms of Service ("Terms") govern your engagement of web design and development services ("Services") provided by BLKQ LLC ("BLKQ," "we," "us," or "our"), a company registered in the United States. By engaging our Services, you ("Client," "you") agree to these Terms.

Our standard service packages and pricing are published on our website at blkqapp.com/web-design. All prices are listed in US Dollars (USD). Prices are subject to change but any agreed-upon pricing in a signed proposal will be honored for the duration of that project.

3. Payment Terms

Payments are processed securely through GoDaddy Payments. All transactions are encrypted and PCI-compliant.

Final payments are due upon project completion notification. If payment is not received within 14 days of the completion notice, we reserve the right to suspend or remove the website from hosting until payment is received. A late fee of $50 may be applied to overdue balances after 30 days.

A "round of revisions" includes a consolidated list of changes submitted within one feedback session. Additional revision rounds beyond what is included in your package may be purchased at $150 per round.

7. Intellectual Property

7.1 Ownership

Upon receipt of full payment, the Client receives full ownership of the completed website design and custom code created specifically for their project. This includes HTML, CSS, JavaScript, and any custom graphics created for the project.

The Client retains all rights to content they provide (text, images, logos, etc.). The Client warrants that they own or have proper licenses for all content provided to us.

8. Refund and Cancellation Policy

8.1 Before Design Work Begins

If you cancel before any design work has started (typically within 48 hours of deposit payment), you are entitled to a full refund of your deposit.

8.2 After Design Work Begins

Once design work has commenced, the deposit is non-refundable as it covers the design, research, and planning work already completed. If you cancel after design work has begun:

If you are not satisfied with the final deliverable, we will work with you through additional revisions (up to 2 extra rounds at no cost) to address your concerns before any cancellation is considered.

9. Warranty and Support

After launch, we provide a post-launch support period as included in your package:

This covers fixing any bugs or issues with the delivered website. It does not cover new features, content changes, or issues caused by third-party services or Client modifications.

10. Limitation of Liability

BLKQ's total liability for any claim arising from our Services shall not exceed the total amount paid by the Client for the specific project in question. BLKQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

11. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the course of the project. This includes business strategies, customer data, login credentials, and any information marked as confidential. This obligation survives termination of the agreement.

12. Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the United States, and the decision of the arbitrator shall be final and binding.

13. Modifications to Terms

BLKQ reserves the right to modify these Terms at any time. Changes will be posted on our website with an updated "Last Updated" date. Existing projects will be governed by the Terms in effect at the time the project was initiated.
